Last year, as many elderly, disabled, and immunocompromised New Mexicans were staying home to protect themselves during the pandemic, we learned that some grocers were taxing food delivered to peoples’ homes – even though food has been tax free in New Mexico since 2004. The problem was an ambiguity in the law, which exempts groceries purchased “at” grocery stores. Thankfully, @govmlg directed the Taxation and Revenue Department to issue a ruling that delivered groceries should not be taxed in most instances. However, to fully fix this problem, we need to address the ambiguity in the law. AND eliminate tax on all food, no matter where it's purchased.

New Mexico's regressive tax on groceries was repealed in 2004, but during the pandemic, we learned that some grocers were taxing food delivered to peoples’ homes – in many cases, elderly, disabled, and immunocompromised New Mexicans who needed to avoid the risk of going to the store. The problem was an ambiguity in the law, which exempts groceries purchased “at” grocery stores.

Thanks to the advocacy of many New Mexicans, the governor directed the Taxation and Revenue Department issue a ruling that delivered groceries should not be taxed in most instances.

However, to fully fix this problem, we need to address the ambiguity in the law. Think New Mexico is supporting House Bill 98, which ensures that any food sold “by” grocery stores (not just “at” the stores) will not be taxed.

Please join us in urging your legislators and the governor to support House Bill 98!

Yesterday, Senate Bill 66 was introduced by Senator Bill Soules (D-Las Cruces), Senator Benny Shendo (D-Jemez), and Representative Susan Herrera (D-Española), among a growing group of sponsors, to lower the maximum annual interest rates of small loans from 175% to 36%!

Please email your legislators and Governor Michelle Lujan Grisham and encourage them to enact Senate Bill 66!
